Q: Why do you take a “Protected Minimum Net” before calculating my share?

A: Our Protected Minimum covers underwriting, structuring, lender negotiations, compliance, due diligence, and relationship management infrastructure. Without it, we couldn't sustain the capital placement operations that make your participation possible. You earn on surplus revenue—we're both motivated to maximize total compensation.

Q: What if I can get better terms going directly to a lender?

A: You might—on one deal, with one lender, if you have that relationship. But you'd miss the benefit of competition. We present simultaneously to 3-5 lenders, which typically improves terms by 0.25-0.75% and increases approval odds. Plus, you save 40+ hours per deal and get a fallback if your preferred lender passes.

Q: Can I negotiate your compensation with sponsors to win deals?

A: Absolutely not. This is grounds for immediate participation forfeiture and potential termination. Our economics are non-negotiable. Rebating, crediting, or altering transaction economics undermines the entire partnership model and damages our lender relationships.

Q: What determines my tier status?

A: Tier assignment is determined per transaction based on: deal preparedness (how much structuring we must do), volume history, execution efficiency, compliance record, and sponsor satisfaction. Higher tiers earn more because they deliver more value. Tier 3 operators typically have 9+ deals annually, provide finance-ready submissions, and maintain flawless compliance.

Q: How quickly do I receive participation payments?

A: Within 15 business days of Afiwi Capital receiving payment from the capital partner. Certain transactions may have a holdback period (up to 120 days) to protect against clawbacks or post-closing adjustments. If compensation is later reduced, we may recoup proportionally from future payments.

Q: What if I terminate the agreement?

A: Transactions introduced before termination remain eligible for participation, provided there's continuous documented activity within rolling 90-day windows. You don't lose credit just because you terminate—your prior introductions are protected as long as they remain active.

Q: Can I participate in deals I don’t directly control?

A: Generally, no. This program is for operators with direct sponsor relationships or asset control—not speculative introductions. If you're making referrals without ongoing deal involvement, our Referral Program (50% flat commission) is the better fit.

Q: What if my sponsor asks about your fees?

A: We handle all fee disclosures directly with sponsors. You are prohibited from discussing our compensation, participation percentages, or the existence of this agreement with sponsors or borrowers. Afiwi Capital controls all fee transparency to maintain professional relationships and deal integrity.

Q: Why should I share revenue instead of building my own capital team?

A: Building in-house capital markets capability costs $150K-$250K annually (salary + benefits for one person), takes 12-24 months to establish lender relationships, creates fixed overhead regardless of volume, and adds licensing/compliance burden. Q: What types of transactions qualify for participation?

A: Commercial real estate (bridge, DSCR, construction, value-add, stabilized), SBA programs, business acquisitions, equipment financing, and mezzanine/preferred equity. Residential mortgages, consumer loans, and securities offerings do not qualify. If it requires institutional commercial capital, we can likely place it.

Q: Do I need a license to be an Operator Partner?

A: No. You're introducing transactions you control or source—not acting as a broker or intermediary. Afiwi Capital handles all capital placement activities requiring licensing or regulatory compliance. No mortgage broker license, securities license, or real estate license is required for operator partnership activities.

Q: Can I introduce the same deal to multiple intermediaries?

A: Once you introduce a transaction to Afiwi Capital, it's protected by 12-month exclusivity. You may not bypass us by placing it elsewhere without written consent. However, if we formally decline in writing, exclusivity for that specific transaction terminates and you're free to pursue other options.

A: We'll review your current deal flow and structure, discuss tier eligibility based on your volume and preparedness, answer questions about economics and processes, review a sample transaction (if available), and determine mutual fit.
